A. Right of Withdrawal
Introduction
Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor attributable to their self-employed professional activity:
Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item of goods.
To exercise your right of withdrawal, you must inform us (Lürzer Obertauern GmbH & Co. KG, Ringstraße 74, 5562 Obertauern, Austria, Phone: 06456 / 72009, Email: webshop@luerzer.at) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached sample withdrawal form, although this is not mandatory.
You can also fill out and submit the sample withdrawal form or another clear statement electronically on our website https://meinfreudenhaus.at/de-at#sc-widerruf. If you make use of this option, we will send you an acknowledgement of receipt of such a withdrawal without delay (e.g. by email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
For returns from Austria and Germany, we will bear the cost of returning the goods. For returns from other countries, you will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
General Information
1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
2) Please do not send the goods back to us freight collect (unpaid).
3) Please note that points 1-2 above are not a precondition for the effective exercise of the right of withdrawal.
